Terms & Conditions of Service

These Terms and Conditions constitute a legally binding agreement between the client (hereinafter referred to as "Client", "You", or "Host") and NEW UTSAVAA (including its operating divisions: New Utsava Tent House, New Utsava Events Company, and New Utsava Production House).

By commissioning an estimate, executing a booking agreement, remitting an advance retainer, or authorizing site mobilization, the Client explicitly acknowledges and accepts all terms outlined herein.

NEW UTSAVAA operates three specialized, self-owned vertical divisions, each upholding distinct technical benchmarks:

• Tent House Division: German aluminum hanger structures, royal carved shamianas, waterproof pavilions, tensile canopies, and luxury furniture infrastructure.
• Events Company Division: End-to-end wedding curation, hospitality, artist coordination, thematic floral architecture, guest management, and itinerary scheduling.
• Production House Division: Concert line-array acoustic systems, intelligent DMX moving head lighting rigs, structural box trussing, P2.6/P3.9 LED walls, and mobile diesel power distribution.

Services may be engaged individually as specialized packages or integrated as comprehensive turnkey solutions.

A date and event booking is formally locked in our production calendar only upon:

• Receipt of the designated Initial Advance Retainer (typically 25%–40%) as stipulated in your quotation.
• Issuance of the signed Service Agreement or digital confirmation voucher from our authorized management desk.

Quotation figures reflect the exact fabrication specifications, inventory quantities, technical personnel count, and logistics distance confirmed. Payments adhere to standard stage milestones:

• Milestone 1 (Booking Date): Advance retainer to secure inventory, structural fabrication, and artist holds.
• Milestone 2 (Site Mobilization / 7 Days Prior): Interim payment for raw material fabrication, logistics dispatch, and technical crew allocation.
• Milestone 3 (Handover / Event Commencement): Final balance settlement prior to final handover or main celebration kickoff.

All invoices are subject to statutory GST and applicable government levies. Any on-site scope expansions or additional gear requirements requested during execution will be billed separately via itemized addendums.

To ensure flawless safety and punctual handover, the Client and venue management shall ensure:

• Clear Site Access: Unobstructed access for transport trucks, crane lifters, and installation crews within agreed setup windows.
• Structural Rigging Compliance: All suspended trussing, lighting grids, and heavy dome canopies strictly adhere to German-certified weight load limits. Safety crew instructions regarding load balances are non-negotiable.
• Ground & Soil Suitability: Notification of underground electrical lines, plumbing, or lawn irrigation systems prior to ground pegging or heavy anchoring.

NEW UTSAVAA guarantees punctual on-time setups, ensuring soundchecks and light alignment are finalized hours before guest arrivals.

In the event celebrations extend significantly beyond contractual schedules, or dismantling windows are restricted by hotel/venue management necessitating overnight express teardown crews, supplementary logistical overtime fees may apply.

Because custom decor materials are procured and fabrication crews are reserved exclusively for your celebration:

• Cancellation > 30 Days Prior: The advance retainer may be credited toward a future mutually agreed date within 12 calendar months, minus unrecoverable custom fabrication expenses.
• Cancellation within 15–30 Days: 50% of the total contract value is payable to cover committed inventory and vendor locks.
• Cancellation < 15 Days Prior: 100% of the contract value is applicable due to active site fabrication, transport mobilization, and crew deployment.

Neither party shall be held liable for failure or delays resulting from acts of God, severe cyclones, unprecedented natural disasters, nationwide civil disruptions, or sudden government executive orders beyond reasonable control.

All proprietary 3D design renders, architectural blueprints, custom fabrication molds, and bespoke lighting choreographies created by NEW UTSAVAA remain our creative intellectual property.

NEW UTSAVAA reserves the standard industry right to document event setups, decor architecture, and production stages for professional portfolio, website showcase, and social media archives, while upholding client privacy and non-disclosure requests when requested in writing prior to the event.

The maximum aggregate liability of NEW UTSAVAA for any claims arising from performance or non-performance under any agreement shall be strictly limited to the total fees received for the specific service in dispute.

These Terms & Conditions are governed by and construed in accordance with the Laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts located in Jaipur, Rajasthan, India.
